  1. One of the problems of the Posse Comitatus Act has been the understanding of the application of the law. In the past several Presidents have come into conflict with the law and have had to tap dance around it to prevent violating the law. In most cases, there is an ongoing conflict between political parties depending on which party is in power at that time. In a review of Shiff’s move, he wants to make it absolute prohibition to engage active-duty forces and federally funded national guard forces to quell violent disturbances. In general the guard can be used as long as it is state funded. We are in a time where the (D) states want the Feds to pay even when it is the state’s statutory duty to maintain law and order. That places the national guard in the same authority as TItle 10 active duty military. I believe that Shiff’s motive now is to try and tie the President’s hands so his Antifa like thugs can destroy cities unabridged from any police type forces than actual local and state police, who in his view would be easy to control simply because the act at the call of the state governor. In short, the occupation of six blocks of Seattle could go totally unabated and the anarchy undermining the Constitution.
