Attorney Gary Kreep could use your prayers

Charles Kerchner, lead plaintiff in an unrelated lawsuit challenging Obama to produce his birth records, sent notice this evening of some serious health issues attorney Gary Kreep is facing.  Gary is representing Alan Keyes in his lawsuit against Barack Obama, also challenging his Constitutional eligibility to hold the office of president. Prayers are needed for Gary and his family.  Gary has been a frequent guest on my radio program, most recently last November.

Quoting from On July 6th, 2010, an ‘unopposed motion for extension to file opening brief’ was filed in the Keyes/Barnett v Obama lawsuit now in the United States Court of Appeals for the Ninth Circuit in California.  Appellants’ seek an extension until August 12th, 2010 to file the opening brief in the Keyes/Barnett v Obama appeal.  The original schedule to file was June 28th, 2010.  Previously, the Court granted Appellants’ an extension until July 12th, 2010, but due to serious complications from back surgery Attorney Gary Kreep is unable to meet that date.  The motion was filed by Attorney Christopher P. Tucker.  Below is an excerpt, regarding Attorney Kreep, from the motion filed yesterday, July 6th, 2010.  The full motion embedded below excerpt.

My thoughts and prayers are with Attorney Kreep and his family…

From the motion filed 7/6/10; Mr. Kreep has represented Appellants throughout the course of this litigation in the District Court, including his attendance at the relevant hearings. Prior to his spinal surgery, Mr. Kreep anticipated recovering in time to meet this Court’s July 12, 2010 deadline for filing Appellants’ opening brief. However, Mr. Kreep suffered several serious complications during his June 25, 2010 back surgery, and he was subsequently placed on a heart pump and transferred to the Intensive Care Unit at Scripps Green Hospital in La Jolla, California on June 29, 2010. July 1, 2010, a five-hour-long bypass surgery was performed on Mr. Kreep’s heart. On July 4, 2010, Mr. Kreep was placed in an induced coma due to additional complications. At the time of this filing, Mr. Kreep remains connected to a breathing tube, and his recovery is expected to take at least several weeks.

Due to Mr. Kreep’s unexpected complications and the uncertain timetable for his recovery, Appellants respectfully request that this Court grant Appellants an extension until August 12, 2010 to file their opening brief.
