At least a hundred people watched three men assault one man, and DID NOTHING.
That is indicative of what is wrong in America today.
And, when the state trooper arrived and identified himself, NOT ONE of those bystanders said, “I want to file assault charges against the three security guards.”
And, even though the event is on video, my guess is that no one has gone to the Alaska State Police internal affairs division and filed a “dereliction of duty” charge against the trooper for aiding the asaulters instead of the victim.
With all of that in mind, the idea of a Constitutional free-speech lawsuit against the security company (and/or the trooper) is probably just a pipe dream.
I guess that’s why they’re called “sheeple”.
Where is the ACLU when you need them? I totally back this gentleman’s constitutionally guaranteed right of free speech in a public place, especially with respect to challenging the government for a redress of grievances. I have personally faced down police officials who attempted to stop sidewalk counseling efforts in front of an abortion clinic. We knew we were within the law on all counts. However, there are material elements about this demonstration which aren’t clear. For instance, are there reasonable size limitations on placards or signs, or the pole used to support the sign? Was traffic flow being physically impeded? Was the public being endangered by the use of this venue? Was he inside the regulated fair grounds or on public property just outside the fairgrounds?
If he was outside the fairgrounds and on public property his case may be much stronger than if he was inside regulated space. Also, a smaller, less physically intrusive sign could have made his position stronger. Absent more knowledge of the particulars I would be personally reluctant to take physical action against the police, but would certainly have taken names and badge numbers and would have sought to contact senior members of governing authorities AND THE NEWS MEDIA. As Tom Kovach noted, it may have been appropriate to demand the arrest of the security personnel; however, that depends on the specifics and the settled case law that relates to those specifics. Meanwhile, I hope this gets some national attention including the particulars. Good luck to the unnamed demonstrator with the noble grievance!
I fully recognize his free-speech rights, but…to follow up on Tom H.’s remarks…
he doesn’t help his case by being a loud-mouthed jerk and antagonistic towards the security guards.
Being a little more measured and responsible would strengthen his legal case as the security guards could claim they he was being belligerent and they were fearful of what he might do next.
Perhaps he should have solicited a lawyer to serve as witness/advisor.
If the protester were black, the ACLU, Justice Dept., and Obama would all over this incident. Political correctness needs to be repealed in November elections.
