Update on Maricopa Audit Legal Challenge:
Friday morning, Superior Court Judge Christopher Coury held a hearing on the request by AZ Dems for a Temporary Restraining Order to stop the audit. Coury ordered a “pause” if the Democrats posted a $1million bond to cover damages. He also ordered the Senate & Cyber Ninjas to produce their policies/procedures for conducting the audit to assure that they’re following all state laws.

The State Senate filed an Emergency Special Action with the Arizona Supreme Court to overturn Judge Coury’s “pause.” The AZ Democrats did not post the bond, so the “pause” became moot and the audit continues.

This afternoon (Sunday), Arizona Supreme Court Justice Clint Bolick heard arguments on the Senate’s request for Special Action. Bolick took no action, but ordered an updated pleading from the State Senate on Tuesday, responses on Wednesday, and a reply on Thursday. Either Justice Bolick or the entire Supreme Court will take up the matter late next week.

(Superior Court Judge Coury is now recused after after learning that attorney Chris Viscovic joined the case, with whom he had a previous working relationship.)

Regarding the Maricopa Audit:
Although legal maneuvers continue, nothing has changed and nothing is likely to change in the near future.
The audit is predicated on a subpoena from the AZ Senate to the Maricopa Board of Supervisors.
The purpose of the subpoena was to obtain the election ballots so an audit could be done. (The Board of Supervisors had possession of the ballots.)
The Board of Supervisors has fought the subpoena tooth and nail.
Superior court has on 2 occasions affirmed the validity of the subpoena for the ballots.
The ballots were turned over to the Senate and the audit has begun.
The Arizona Democratic Party and the Board of Supervisors are desperately grasping at straws trying to stop the audit, but they have no legal grounds on which to object, and it is very unlikely they will prevail.
I can’t see anything stopping the audit from being completed.

  1. so what does this mean , that the judge gonna recuse himself .. because that guy used to work for that judge .. lets hope they continue this going forward… what is your thought on this . .besides what medic said.

  2. so what does this mean .. is the judge recusing himself because of one of his interns is know the lawyer for the ninja auditors.. wht is your take on this ANDREA.. trying to figure this out 🙂

  3. I really hope justice will finally prevail. I am afraid to get my hopes up because time and time again we find that the deck has been stacked against the truth. The questions that keeps ringing in my head –

    Where have the ballets been since last November?
    Have they been under 24/7 guard in a surveillance area?
    How do we know these are the real ballets?

    While I hope this audit is a good thing I worry that (if there has been more evidence interference and tampering) it will be used as another “example” for cnn to use as proof of a free and fair election.

  4. It is difficult to stay calm with all of the gerrymandering going on, then collusion between Judge and new attorney…. when will the DEMS grow up and realize they need to step aside and let the adults handle this, and wait properly and well behaved
    for the eventual Punishments that Will Certainly Be Doled out to them. Patience, high hopes and crystal clear expectations on this end!
