“First, this was not a block on Trump’s use of the Alien Enemies Act. It was simply a punt and an effort to tie it up a bit longer. Instead of just being men, they punted it back to the Fifth Circuit. Now, the Fifth Circuit will actually end up siding with Trump on his legal authority and use of the Alien Enemies Act.
“However, they will need to clarify some arbitrary amount of days that the administration must give as notice to the illegal immigrant gang member deportees. Today, 24 hours was ruled not enough. “To be clear, we decide today only that the detainees are entitled to more notice than was given on April 18.”
“Really this is just a useless and pathetic procedural step that the Fifth Circuit must now decide on to please the weak Supreme Court Justices. It could be 48 hours, it could be 7 days, it could be 90 days. We shall see.
“What would I do? Very simple. If I was Trump and @StephenM, I would immediately notify every illegal immigrant possible. A blanket notification for everyone we want to deport under the Alien Enemies Act. Start the clock tomorrow on whatever length of time the Fifth Circuit ends up deciding on.”
COMMENTS:
— What’s absurd, is ruling anything when there is no law, or even clear guidelines. The Supreme Court isn’t here to issue legal guidelines. They’re here to clarify hazy matters. Handling illegal alien criminals is not a ‘hazy’ matter.
— How about when they came here illegally, they had notice they aren’t supposed to be here, so the clock started the second they entered.
— Alito’s dissent is spot on. He’s basically like this court is doing whatever it wants regardless of precedent just because it’s Trump. He didn’t say it explicitly but that’s what I got. He explained SCOTUS just made up a class even when the lower court didn’t. He also pointed the ex parte phone call to the judge.
— Nope! Why are we even allowing this? American citizens don’t even get notified when the police have a warrant for their arrest. Now we have to give foreign invaders a notice? That is a special accommodation for an illegal alien. SCOTUS HAS FAILED!!
— Illegals were given due notice while Trump was running for his 2nd term – everyone knows and understands that. That being the case, we’ll use Jan. 20th 2025 as their official notice date to be removed under the Alien Enemies Act.
— The Supreme Court and lower courts are compromised. They are part of the corrupt government establishment. Now the question is what do we do about it. We are not violent or corrupt like the Left so what is left to us to do next?
— Well I think the #Notice for all the illegal immigrants it has been giving to them by the legitimate President of the United States on Jan. 20th, 2025, so there is no need to notify them again, the only notification they gonna get, when #ICE officers knock on their doors.
