But does the General understand that it wouldn’t matter WHO is the Attorney General.

Case is DISMISSED.

Halligan’s appointment as interim U.S Attorney is adjudged DEFECTIVE and all actions flowing from are set aside.

First, an observation from “Just Human” (Kyle) who studies court docs very closely and interprets their portent:

“An appeal of the order is a near certainty, but it’s not a given that the case can be refiled even though it was dismissed without prejudice. We are well past the SOL.

(NOTE! My attorney friend says that statement is wrong – there ARE 60 days in which to refile the case. The Senate is the first line of the problem by not confirming Trump’s appointments or go into recess to let that happen. Then you’ve got a crazy statute that allows the court to intervene the process of who the US Atty is. And that statute — separation of powers — is not being adhered to. The Judiciary is trying to micro-manage the executive branch without authority. Every one of these issues have to be appealed, and Republicans are stalling to run out the clock. All of them.)

If any other prosecutor from EDVA would have signed the indictment the case would not be dismissed even with Halligan’s appointment being invalidated.

But because Halligan was the ONLY prosecutor to sign it, which is unusual, and her appointment is unlawful (according to the order), the case is dismissed. 

The reason no other prosecutor signed the indictment is because the case shouldn’t have been brought in the first place. The evidence isn’t there and the indictment misstates testimony and is factually flawed. 

(NOTE: My Attorney friend says the evidence IS there, and someone else should have signed the indictment with Halligan. Bondi should have been the one to sign. Wrong that the case was not signed.

Halligan presented 3 separate counts against Comey to the Grand Jury, A 3-count indictment. The GJ heard ALL the evidence supporting the 3 counts, but refused to indict on one of the 3 counts.

So the prosecutor had to go back to amend the indictment of the 3rd count the GJ refused to indict on, making it now a 2-count indictment. And that one was not presented to the court. The criticism — WHICH IS false — is that the GJ never saw the final indictment, and it hadn’t been represented to the GJ, which had already seen the indictments when initially presented. These are the games being played.

And the district judges in the courts are going along with these red herrings and roadblocks. The solution: Trump needs to have his team in place still fight these courts and district judges.

Congress cannot do a thing about it.

BOTTOM LINE: The Judicial System is being used to slow down the Trump administration, with the assistance of the US SENATE, including the Republican Party.)

Back to Just Human’s assessment:

“The case was always doomed.

 So why was it brought at all? Why did Trump and Bondi put Halligan up to this if it was doomed from the get go? 

 I have some thoughts. 

 I think it was about getting materials unsealed and/or disclosed. 

Here’s an initial list of documents we now have thanks to the Comey case: 

– A half dozen Comey-Richman emails

– A text message thread between NYT reporter Michael Schmidt and Daniel Richman

– Comey’s alleged handwritten note

– a description of the four Arctic Haze search warrants for Daniel Richman’s devices and iCloud. 

– Court order to DOJ to have the search warrants unsealed, so perhaps we will eventually see the actual warrants

The significance of any one of these items may not yet be realized. 

It was never about “getting Comey.”

It was about getting materials for other cases.”
